These Terms of Service govern your use of prettylittlecharm.com and purchases made from Pretty Little Charm.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service and the policies referred to within them.

Nothing in these terms excludes, restricts or modifies any rights, guarantees or remedies that cannot legally be excluded, including rights under the Australian Consumer Law.

Important Notice About Pandora

Pretty Little Charm is an independent jewellery store. We are not Pandora, we are not affiliated with Pandora and we do not sell genuine Pandora products.

Our charms, bracelets and other jewellery may have a style, appearance or function similar to products sold by Pandora. Some products may also be designed to fit popular charm bracelet styles. However, this does not mean that our products are manufactured, supplied, approved, sponsored or endorsed by Pandora.

Pretty Little Charm products are made using the materials stated in their individual product descriptions. These materials, manufacturing methods, finishes and product specifications may be different from those used in genuine Pandora jewellery.

Our products do not carry or use the official Pandora logo and must not be mistaken for genuine Pandora products. Any reference to compatibility with a particular bracelet style describes product fit only and does not indicate that the product was manufactured or authorised by Pandora.

If you are looking for genuine Pandora jewellery, you should purchase directly from Pandora’s official website or an authorised Pandora retailer.

Please do not purchase from Pretty Little Charm if you specifically require or expect to receive genuine Pandora products. By placing an order with us, you acknowledge that you are purchasing Pretty Little Charm products and not products manufactured or sold by Pandora.

Eligibility

Our store is intended for customers aged 18 or over.

If you are under 18, you may use the website or place an order only with the permission and supervision of a parent or legal guardian. The parent or legal guardian is responsible for the purchase and use of the website.

By placing an order, you confirm that the information you provide is accurate and that you are legally permitted to use the selected payment method.

You may be able to create an account to access certain features, view orders or participate in our loyalty program.

You are responsible for:

We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, compatibility information and availability are accurate.

The appearance of colours and details may vary slightly because of:

• Screen and device settings

• Photography lighting

• Manufacturing variations

• Hand finished details

• Product updates

Minor variations that do not materially affect the product are not necessarily faults.

However, nothing in this section limits your rights if a product is faulty, unsafe, incorrectly described, substantially different from its description or otherwise fails to meet a consumer guarantee.

Customers are responsible for reviewing product descriptions, measurements, sizing and compatibility information before ordering.

Jewellery Care

Jewellery can be affected by normal wear, chemicals, moisture, impact and storage conditions.

Customers should follow any care instructions provided with the product or displayed on our website.

Jewellery care requirements do not limit your rights where an item is faulty or fails to meet an applicable consumer guarantee.

Our separate 3 month worry free replacement promise may also provide a replacement for accidental damage, subject to the conditions in our Return and Refund Policy.

Product Availability

All products are subject to availability.

An item appearing on our website does not guarantee that it will remain available until the order is processed.

If an item becomes unavailable or is found to be damaged before dispatch, we may:

• Contact you to arrange an alternative

• Wait for the item to be restocked with your agreement

• Remove and refund the unavailable item

• Cancel and refund the affected order where necessary

Any refund will be issued to the original payment method.

Orders and Acceptance

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges that we received your order. It does not prevent us from declining or cancelling an order before fulfilment where there is:

• A pricing or product information error

• A stock availability problem

• Suspected fraud or unauthorised payment

• Promotion or loyalty program misuse

• An incomplete or undeliverable address

• Another reasonable operational or legal reason

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

Prices and Currency

Product prices and available currencies are displayed on our website.

Our store normally selects and displays the customer’s local currency automatically. If the correct currency does not appear, a currency selector is available near the bottom of the website.

Currency conversion rates may change. A bank, card provider or payment service may apply its own conversion rate or fee.

The final price, currency, shipping charge and order total are shown at checkout before payment is submitted.

If a genuine pricing error occurs, we may contact you to confirm whether you wish to proceed at the correct price or cancel and refund the affected item.

Payment

You authorise the selected payment provider to charge the final amount displayed at checkout.

Available payment providers may include:

• PayPal

• Afterpay

• Zip

• Credit or debit card providers

Payment providers may apply their own terms, eligibility requirements, fees and privacy practices.

Pretty Little Charm is not responsible for an independent payment provider’s decision to approve or decline its payment service. However, this does not limit our responsibilities as the seller.

Promotions and Discount Codes

Promotions and discount codes may have separate:

• Start and end dates

• Product requirements

• Minimum purchase requirements

• Location restrictions

• Usage limits

• Exclusions

Unless the promotion states otherwise, discount codes and offers cannot be combined or applied retrospectively after checkout.

We may refuse or cancel the use of a promotion where we reasonably believe there has been fraud, misuse, duplication or a technical error.

This does not affect orders that have been accepted and lawfully completed unless another legal right applies.

Buy One Get One Free Promotions

For a buy one get one free promotion, the total promotional discount is allocated proportionately across all qualifying items.

For example, if two charms normally cost $40 each and the total paid under the promotion is $40, the amount paid is allocated equally as $20 to each charm.

Any eligible refund will be calculated using the amount paid and allocated to the affected item after the promotion has been applied, rather than its undiscounted display price.

The maximum refund for an item is the amount paid and allocated to that item.

Loyalty Program

Pretty Little Charm offers a loyalty program. Information about earning, redeeming and managing rewards is available on our Loyalty Page.

Loyalty rewards:

• Have no cash value

• Cannot be sold or transferred unless we expressly permit it

• Cannot normally be applied after an order has been completed

• May be subject to expiry dates, product exclusions or separate conditions

• May be corrected or removed if credited because of an error, cancelled order, returned purchase, fraud or misuse

We may update the loyalty program from time to time. Changes will not remove consumer rights that already apply to a completed purchase.

Gift Cards

Gift cards are governed by the conditions displayed when they are purchased or issued.

Gift cards cannot be exchanged for cash or refunded except where required by law.

Customers are responsible for protecting gift card details from unauthorised use. Please contact us promptly if you believe a gift card has been used without permission.

Order Cancellations and Changes

Requests to cancel an order, change an item, select another size or correct a delivery address must be submitted within 12 hours after the order is placed.

Submitting a request within 12 hours does not guarantee that the change can be completed if processing or dispatch has already begun.

Tracking information may be received after a parcel has physically left the warehouse.

Orders cannot be cancelled or changed after dispatch.

If an order can no longer be cancelled, the customer may request a return after delivery under our Return and Refund Policy.

Preorders and Backorders

We do not routinely sell preorders or backorders.

If a preorder or backorder is offered, it will be clearly identified in the product name and product description. This information will also appear on the customer’s order confirmation or receipt.

The product page will include an estimated dispatch period.

If an order contains both available and preorder products, the items may be held and shipped together or sent separately, depending on the information displayed or communicated at the time of purchase.

Shipping and Delivery

Order processing, fulfilment locations, shipping charges, estimated delivery times, customs charges and parcel claim procedures are explained in our Shipping Policy.

Orders containing 6 or more items qualify for free standard shipping.

Customers are responsible for providing a complete and accurate delivery address.

Delivery estimates are provided as a guide and are not guaranteed delivery dates.

Nothing in these terms limits any rights or remedies that apply when products are not supplied within an agreed or reasonable time.

Returns Refunds and Replacements

Returns, refunds, incorrect items, missing items, faulty products and our 3 month worry free replacement promise are governed by our Return and Refund Policy.

The Return and Refund Policy forms part of these terms.

Our voluntary return and replacement promises are provided in addition to rights available under the Australian Consumer Law and other applicable laws.

Customs Duties and Import Charges

International customers are responsible for customs duties, taxes, handling charges and other import costs imposed by the destination country unless checkout expressly states that these charges are included.

Customs processing may delay delivery. Such delays are outside our direct control.

Customers are responsible for providing any information reasonably requested by their local customs or delivery authority.

Intellectual Property

The website and its content, including text, product photographs, graphics, logos, designs, page layouts and software, are owned by or licensed to Pretty Little Charm and are protected by applicable intellectual property laws.

You may use the website for personal shopping and other lawful personal purposes.

You must not reproduce, distribute, modify, publish, sell, license or commercially exploit our website content without prior permission, except where permitted by law.

Third party names, characters, logos and trademarks displayed on products or collections remain the property of their respective owners.

Reviews Photographs and Submitted Content

If you submit a review, photograph, comment or other content, you confirm that:

• You have the right to submit it

• It accurately reflects your experience

• It is not false, misleading or deceptive

• It does not infringe another person’s rights

• It does not contain unlawful, abusive, threatening or harmful material

You grant Pretty Little Charm a non-exclusive, worldwide and royalty free licence to display, reproduce and adapt the submitted content for operating and promoting our store, subject to applicable privacy and consumer laws.

We may moderate or remove content that is unlawful, abusive, fraudulent, misleading, irrelevant or in breach of these terms.

We will not knowingly publish fake or misleading reviews.

Third Party Services and Links

Our website may use or provide links to services operated by third parties.

Third party services are governed by their own terms and privacy policies.

To the extent permitted by law, Pretty Little Charm is not responsible for the content, availability or independent conduct of a third party service.

This does not limit any responsibility the law places on Pretty Little Charm as the seller of your products.

However, we do not guarantee that the website will always operate without interruption, delay or technical error.

We may temporarily suspend or change parts of the website for maintenance, security, legal or operational reasons.

We are not responsible for indirect or consequential loss where excluding that loss is legally permitted and where the loss was not reasonably foreseeable.

Indemnity

To the extent permitted by law, you are responsible for loss reasonably caused by:

• Your unlawful use of the website

• Your infringement of another person’s rights

• Fraudulent activity connected with your account

• A material breach of these terms

This section does not require you to compensate Pretty Little Charm for loss caused by our own breach, negligence or unlawful conduct.

Suspension and Termination

We may suspend or terminate access to an account or website feature where we reasonably believe there has been:

• Fraud or attempted fraud

• Unlawful activity

• A serious or repeated breach of these terms

• A threat to the website, customers or other users

Termination does not remove any payment obligation or legal right that arose before termination.

Updated terms apply from the date shown at the top of this page.

Changes will not remove rights that already apply to an earlier purchase.

Severability

The remaining terms will continue to apply.

No Waiver

If we do not immediately enforce a provision of these terms, that does not mean we waive the right to enforce it later.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any terms displayed for a specific promotion or product, form the agreement between you and Pretty Little Charm regarding use of the website and purchases.

Governing Law

These terms are governed by the laws of New South Wales, Australia.

The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights a consumer has to bring a claim in another location under applicable law.
